This bill is constitutional. It exercises Congress's enumerated power over the federal purse by rescinding previously appropriated funds and reallocating them to child care programs. It does not infringe any right protected by the Bill of Rights, restrict individual sovereignty, violate decentralization principles, or deny due process or just compensation.

  • ✓ Passes · Enumerated powers
Congress has explicit constitutional authority over federal spending under Article I, Section 8, Clause 1 (the Taxing and Spending Clause), which grants Congress the power to 'pay the Debts and provide for the common Defence and general Welfare of the United States.' Rescinding funds from one agency and appropriating them to another for child care programs is a standard exercise of this power. The…
  • ✓ Passes · Bill of Rights
The bill does not restrict speech, religion, assembly, press, petition, the right to keep and bear arms, protection against unreasonable searches and seizures, self-incrimination, due process, takings, fair trial, jury trial, cruel and unusual punishment, or any other right enumerated in the first ten amendments. It is a funding reallocation that affects only federal agencies and their budgets, no…
  • ✓ Passes · Individual sovereignty
The bill imposes no restrictions on what individuals may do with their person, property, speech, labor, or belief. It does not mandate, prohibit, or condition any private conduct. It merely redirects federal funds from immigration enforcement to child care subsidies. The government bears no burden to justify a restriction because no restriction exists.
  • ✓ Passes · Decentralization
The bill passes all four questions of the decentralization test. (1) Individuals and families cannot fund national child care programs on their own, so federal involvement is appropriate for this scale of spending. (2) Local communities cannot replace $70 billion in federal funding. (3) States cannot unilaterally rescind federal immigration enforcement funds. (4) The bill does not consolidate deci…
  • ✓ Passes · Due process and takings
The bill does not deprive any person of life, liberty, or property without due process of law. It does not take private property for public use without just compensation. It reallocates federal funds that were already appropriated to federal agencies; no private party has a vested property right in those appropriations. The Fifth Amendment's Due Process and Takings Clauses are not implicated.
