What H.R. 5517 does, in plain terms

Northern Border Security Enhancement and Review Act This bill requires the Department of Homeland Security (DHS) to regularly perform a threat analysis of the northern U.S. border. The analysis must be performed every two years and include terroristic and criminal threats, improvements needed to prevent terrorism and reduce criminal activity, and whether preclearance and advance inspection operations at northern ports of entry could prevent terrorists from entering in the United States. DHS must (1) update its northern border strategy after performing each threat analysis, and (2) provide a classified briefing to Congress. If DHS determines no update is required, DHS must notify Congress. U.S. Customs and Border Protection’s Air and Marine Operations (AMO) must develop performance measures to assess the AMO’s effectiveness at securing the northern border between ports of entry in air and maritime environments.

This bill is fully constitutional. It directs the Department of Homeland Security to conduct threat analyses, update strategy, and develop performance measures for the northern border — all within the federal government's enumerated immigration and national security powers. It imposes no restrictions on individual rights, does not centralize power beyond the necessary federal role, and follows proper legislative and executive procedures.

  • ✓ Passes · Enumerated powers
The federal government has explicit constitutional authority over immigration, naturalization, and border security under Article I, Section 8, Clause 4 (naturalization) and the inherent sovereign power to control and secure the nation's borders. Requiring threat analyses and strategy updates for the northern border falls squarely within these powers.
  • ✓ Passes · Bill of Rights
The bill does not infringe any provision of the Bill of Rights. It mandates internal government analysis, reporting, and performance measurement — it does not regulate speech, religion, assembly, press, petition, arms, quartering, search and seizure, self-incrimination, due process, takings, trial rights, or cruel and unusual punishment. No individual rights are restricted.
  • ✓ Passes · Individual sovereignty
The bill imposes no restrictions on what individuals may do with their person, property, speech, labor, or belief. It directs the government to study threats and update its own operational strategy. There is no burden on individual liberty, and therefore no constitutional justification is required from the government.
  • ✓ Passes · Decentralization
Border security is an inherently federal function — no individual, family, local community, or state can independently secure an international border against terrorism and transnational crime. The bill does not consolidate decision-making upward beyond the minimum necessary; it merely requires the existing federal border agency to analyze threats and measure its own performance. All four questions…
  • ✓ Passes · Due process and takings
The bill does not bypass due process, presume guilt, or take property. It requires internal government analysis and reporting — no adjudications, no deprivations of life, liberty, or property, and no takings of private property. Procedural and substantive due process are fully respected.
