✓ Passes · Enumerated powers
The operational core is lawful federal power over the seat of government: Article I, Section 8, Clause 17 gives Congress exclusive legislation over the District of Columbia, executed by the President under Article II, Section 1 and Article II, Section 3. Work on federal lands rests also on Article IV, Section 3, Clause 2 governing federal property. Prize competitions, research, disease diagnostics… -
✓ Passes · Bill of Rights
The order directs habitat remediation, sterile-insect techniques, diagnostics, therapeutics, prize competitions, and labeling exploration. It does not restrict speech, religion, press, assembly, or petition under the First Amendment; does not regulate arms under the Second Amendment; does not authorize searches, seizures, or surveillance under the Fourth Amendment; does not compel testimony under … -

The order imposes no mandate on persons, no restriction on movement, bodily decisions, speech, belief, labor, or use of property, and no compulsory medical, pesticide, or biotechnology exposure. Residents remain free to use or decline personal repellents, treatments, or property measures. Government bears no burden here because it restricts nothing; action is limited to public-land management, vol… -

Research, prize competitions under 15 U.S.C. 3719, and an EPA regulatory framework are informational and limited federal functions. Section 2(d) describes DC work as a model for later voluntary adoption, not a federal mandate dis… -
✓ Passes · Due process and takings
No fines, seizures, quarantines, mandates, or property appropriations are ordered. Habitat work is directed on lands subject to Federal jurisdiction throughout DC, consistent with the Fifth Amendment Takings Clause requirement that private property not be taken without just compensation because no private taking is directed. Controls on non-federal community lands are to proceed through a plan dev…
