Policy. Tens of millions of Americans lack access to employer-sponsored retirement plans. Workers in small businesses, part-time workers, independent contractors, and self-employed workers face unnecessary barriers to saving for retirement. My Administration intends to give these often-left-out American workers access to the same type of retirement-savings opportunities offered to every Federal worker and to establish an easy and transparent way for eligible workers to obtain up to a $1,000 match for their savings. Executive Order 14403 is largely consistent with constitutional principles. It operates within federal authority over taxation and spending, does not infringe on individual rights, and appropriately delegates implementation to states and private actors. However, the establishment of a federally administered website that lists and filters private-sector IRAs raises minor concerns about government endorsement and potential overreach into areas better handled by private markets or states, though these are not constitutional violations.
-
✓ Passes · Enumerated powers
The order's primary mechanisms—the Federal Saver's Match and tax treatment of IRAs—are grounded in Congress's taxing and spending powers under Article I, Section 8, Clause 1. The order also implements provisions of the SECURE 2.0 Act (Public Law 117-328), which was enacted pursuant to these powers. The executive action does not create new legal obligations but directs agencies to implement existin… -
✓ Passes · Bill of Rights
The order does not restrict speech, religion, assembly, press, petition, arms, quartering, search and seizure, self-incrimination, due process, trial rights, or cruel and unusual punishment. It is purely facilitative, providing information and encouraging voluntary participation in retirement savings. No provision of the Bill of Rights is implicated. -
✓ Passes · Individual sovereignty
The order does not restrict individual liberty. It creates a voluntary program: individuals may choose to open an IRA and receive a match, but are not compelled to do so. The government is not taking property or labor; it is offering a benefit. The burden of justification for any restriction is not triggered because there is no restriction. -
✓ Passes · Decentralization
The order does not consolidate decision-making at the federal level in a way that violates decentralization principles. Individuals can handle retirement savings on their own, and the order actually facilitates that. States are not preempted; the order does not interfere with state regulation of IRAs. The federal role is limited to providing information and administering a tax credit, which is a l… -
✓ Passes · Due process and takings
The order does not take property without just compensation, nor does it deprive anyone of life, liberty, or property without due process. It imposes no penalties or obligations. The Federal Saver's Match is a voluntary benefit, and the order explicitly states it does not create any enforceable right (Section 8(c)). There is no deprivation of any existing right.

“VFA SI Solution”
Worker Retirement Savings Access Act of 2026
Establish a federal website (TrumpIRA.gov) to expand American workers' access to retirement savings accounts, likely via simplified enrollment, auto-enrollment options, and promotion of tax-advantaged IRAs.
Bipartisan rationale: Democrats gain expanded retirement security for low-wage/gig workers without employer mandates (aligns with worker protections); Republicans secure personal savings choice, blocks tax hikes, and adds strict oversight to prevent bureaucracy (honors federalism and fiscal restraint); both prefer congressional control over executive fiat to protect institutional balance.
Article I, Section 8, Clause 1 Article I, Section 8, Clause 3 Article I, Section 8, Clause 18 Amendment X
