✓ Passes · Decentralization
The order operates entirely within the federal executive branch. It does not involve state or local governments, nor does it affect individuals or families. The four-question test is not applicable because the action is internal to the federal government and does not shift decision-making upward from lower levels of government. The Tenth Amendment is not implicated. -
✓ Passes · Due process and takings
The order does not deprive any person of life, liberty, or property without due process of law. It does not take private property for public use without just compensation. It applies only to future government contracts and to existing contracts that may be modified, restructured, or renegotiated 'to the maximum extent practicable and consistent with law,' which preserves existing contractual right…

Executive Order 2026-08900: Promoting Efficiency, Accountability, and Performance in Federal Contracting
Direct federal agencies to improve efficiency, accountability, and performance in government contracting through better metrics, oversight, and reforms.
Bipartisan rationale: Democrats gain accountability and small business protections against waste; Republicans secure performance metrics and spending caps reducing bureaucracy — both prioritize institutional norms by citing statutes, adding sunset/oversight to prevent executive overreach.
