Purpose. My Administration has worked relentlessly to undo the disastrous immigration policies of the prior administration. Those policies produced a deluge of immigrants, without serious consideration of how those immigrants would affect America's interests. Most significantly, the prior administration permitted millions of aliens to enter the United States illegally, to the detriment of public safety, national security, and the rule of law. International cartels, transnational criminal organizations, terrorists, and foreign malign actors took advantage of those open borders policies. The prior administration also permitted abuse of the refugee process, swamping towns and cities with aliens and, in some cases, forcing them to declare emergencies to combat the...

Federal authority over immigration exists, but Executive Order 14351 uses it to create Gold Card eligibility, deem gifts to satisfy statutory EB-1/EB-2 merit and waiver standards, allow corporate transfer, and establish funds and fees. That legislates new visa policy reserved to Congress under Article I, requiring a congressional rewrite. No direct Bill of Rights, sovereignty, decentralization, or takings violation was found.

✗ Concern · Enumerated powers
Immigration and naturalization are federal powers under Article I, Section 8, Clause 4, and Congress has legislated employment-based categories and numerical limits in 8 U.S.C. 1151 et seq. and 8 U.S.C. 1153(b). The constitutional defect is separation of powers under Article I, Section 1 and Article II, Section 3: the President must faithfully execute the laws, not create a new immigrant-visa path… -
✓ Passes · Bill of Rights
No provision directs search, seizure, speech suppression, religious targeting, arms restriction, or punishment. Visa adjudication remains subject to public safety and national security screening. No First through Eighth Amendment right is infringed on its face. Any wealth-based distinction does not violate an enumerated right under the first ten amendments; equal-protection concerns arise under th… -
✓ Passes · Individual sovereignty
The program does not prohibit any person from speaking, worshiping, working, owning property, or petitioning. Participation is optional for the applicant and sponsor. The sovereignty concern is indirect: conditioning expedited access to a government benefit on a large payment burdens equal access and risks favoring wealthy applicants, but it does not restrict what an ordinary person may do with th… -
✓ Passes · Decentralization
Admission of aliens and establishment of uniform naturalization rules are inherently national functions under Article I, Section 8, Clause 4 and Article I, Section 8, Clause 3. Individuals, counties, and states cannot separately set immigrant-visa eligibility or visa numbers without destroying uniformity. The order operates at the federal level where the Constitution places this power, and does no… -
✓ Passes · Due process and takings
Gifts under 15 U.S.C. 1522 are described as voluntary and unrestricted, with administrative and processing fees for expedited service. No property is seized, no fine imposed, and no physical or regulatory taking occurs under the Fifth Amendment Takings Clause. The order preserves applicable law, visa caps under 8 U.S.C. 1151 et seq., screening, and agency adjudication, and Section 5(c) disclaims c…
