This delay preserves speech in the short term but does so by unconstitutional means: the President repeatedly suspends, rewrites, and grants prospective immunity under a valid Act of Congress and claims exclusive power to bar State enforcement, violating the Take Care Clause in Article II, Section 3 and the separation of powers in Article I, Sections 1 and 7. The method requires structural correction by Congress, not by extended Executive non-enforcement.

  • ✗ Concern · Enumerated powers
Article II, Section 1 vests executive power and Article II, Section 3 requires the President to take Care that the Laws be faithfully executed; the lawmaking power is vested in Congress by Article I, Section 1. Congress exercised its Article I, Section 8 authority over foreign and interstate commerce and national defense in Public Law 118-50. A time-limited delay of enforcement for orderly impleme…
  • ✓ Passes · Bill of Rights
The order itself does not restrict speech, religion, assembly, press, arms, search protections, or other guarantees in the first ten Amendments. In practical effect it leaves First Amendment-protected expression on TikTok available longer by delaying enforcement. The threat to speech comes from the underlying statute, not from this delay. No provision authorizes search, seizure, compelled testimon…
  • ✓ Passes · Individual sovereignty
The order does not itself restrict any person's body, property, speech, labor, worship, or belief; it relieves private providers and users of threatened penalties during the delay period. The burden-of-justification concern therefore does not attach to this order standing alone, even though the underlying divest-or-ban statute raises separate First Amendment and Ninth Amendment individual-sovereig…
  • ✗ Concern · Decentralization
Regulation of a foreign-adversary-controlled communications platform implicates foreign commerce and national security under Article I, Section 8, Clauses 3, 10, and 11, so some federal role is the minimum necessary and individuals or counties cannot resolve it alone. The order nevertheless fails decentralization because section 1(d) claims exclusive Executive authority and directs the Attorney Ge…
  • ✗ Concern · Due process and takings
Under the Fifth Amendment Due Process Clause and Article II, Section 3, the Executive may exercise case-by-case prosecutorial discretion but may not by decree rewrite liability already fixed by statute. Subsections 1(a) and 1(c) order the Department of Justice to treat past and future noncompliance as having no violation and no liability from January 19, 2025 through December 16, 2025, and to issu…
