Order avoids creating a new federal flag-burning crime and channels ordinary offenses to state and local law, but its directive to target protected symbolic speech for prioritized prosecution and visa or removal consequences violates First Amendment and individual sovereignty principles, requiring rewrite to remove expression-triggered penalties.

  • ✓ Passes · Enumerated powers
Under Article II, Sections 1 and 3 the President has authority to direct executive officers to faithfully execute existing laws and prioritize enforcement. Directing the Attorney General to enforce existing content-neutral federal criminal and civil laws is within that power. Directing the Secretary of State and Secretary of Homeland Security to act within their respective authorities under immigr…
  • ✗ Concern · Bill of Rights
First Amendment protects symbolic expression including flag burning as political speech under Texas v. Johnson, 491 U.S. 397 (1989). Sections 2(a)-(b) limit enforcement to content-neutral laws causing harm unrelated to expression, which is consistent with the First Amendment. Section 2(d), however, directs denial or revocation of visas and removal when foreign nationals have engaged in flag-desecr…
  • ✗ Concern · Individual sovereignty
Symbolic political protest, including desecration of the flag as expression of contempt or opposition, is a core exercise of individual conscience, speech, and belief. The burden is on the government to justify restricting it. To the extent the order encourages vigorous prosecution and immigration penalties centered on the expressive content of flag desecration, with stated intent to clarify or na…
  • ✓ Passes · Decentralization
Violent crimes, property destruction, disorderly conduct, and open burning are traditionally state and local matters under the Tenth Amendment. Section 2(b) respects that by referring suspected state or local violations to state or local authorities rather than federalizing them. Immigration decisions in Section 2(d) are necessarily federal. The order does not create a new federal flag-desecration…
  • ✓ Passes · Due process and takings
The order states it will be implemented consistent with applicable law and the Constitution, creates no new criminal liability by itself, and directs enforcement through existing criminal and civil laws which carry Fifth Amendment notice and hearing protections and Sixth Amendment trial protections. Section 2(d) requires action pursuant to Federal law and an appropriate determination, so on its fa…
