Executive Order 14337 only revokes a prior executive order and preserves existing statutory authority. It claims no new power, restricts no rights, takes no property, and reduces centralized executive direction, making it fully consistent with the Constitution. The SI review finds no violation.
-
✓ Passes · Enumerated powers
Under Article II, Section 1 and Article II, Section 3, the President has authority to manage executive-branch policy and to revoke a prior executive order directed to executive agencies. This order exercises that power only: it revokes Executive Order 14036 and adds no new regulatory mandate, tax, or spending program. It expressly states it does not impair authority granted by law and is subject t… -
✓ Passes · Bill of Rights
This order creates no restriction on speech, religion, press, assembly, arms, search and seizure, trial rights, or other protections in the first ten Amendments. Under the First Amendment and Fourth Amendment, there is no compelled speech, censorship, or search. It removes prior executive direction rather than imposing a new burden, so no Bill of Rights provision is implicated. -
✓ Passes · Individual sovereignty
This order imposes no restriction on person, property, speech, labor, or belief. It removes an executive competition-policy overlay rather than compelling private conduct. With no burden imposed, the government needs no additional compelling justification, and individual sovereignty under the Ninth Amendment and the liberty protected by the Fifth Amendment is left intact or enlarged. -
✓ Passes · Decentralization
Under the Tenth Amendment, revocation moves power away from centralized presidential direction of competition policy and returns discretion to Congress, agencies acting under statute, states, markets, and courts. It does not consolidate decision-making upward; it withdraws a higher-level directive. The four-question test is satisfied in direction because the federal executive is reducing its own f… -
✓ Passes · Due process and takings
Under the Fifth Amendment Due Process Clause and Takings Clause, there is no deprivation of life, liberty, or property, no criminal process, no seizure, and no taking for public use. Section 2 expressly preserves authority granted by law, requires implementation consistent with applicable law, and creates no new enforceable burden, so notice, hearing, and just compensation requirements are not tri…
