Purpose. Abundant energy is a vital national- and economic-security interest. In conjunction with domestic fossil fuel production, nuclear energy can liberate America from dependence on geopolitical rivals. It can power not only traditional manufacturing industries but also cutting-edge, energy- intensive industries such as artificial intelligence and quantum computing. Between 1954 and 1978, the United States authorized the construction of 133 since-completed civilian nuclear reactors at 81 power plants. Executive Order 14300 directs reform, reorganization, and timed rulemaking for the existing federal nuclear licensing regime without restricting rights, taking property, bypassing due process, or claiming new federal subject-matter power. Residual separation-of-powers tension over presidential direction of an independent commission is contained by the order's consistent-with-statute and rulemaking safeguards, leaving it constitutional.

  • ✓ Passes · Enumerated powers
Federal regulation of civilian nuclear energy rests on Article I, Section 8, Clause 3 commerce power and Clause 18 necessary-and-proper authority, as exercised in the Atomic Energy Act and the cited Public Law 118-67 directive on efficient licensing. The President acts under Article II, Section 1 executive power and Section 3 duty to take care that the laws be executed by directing rulemaking, reo…
  • ✓ Passes · Bill of Rights
No provision directs or authorizes restriction of speech, religion, press, assembly, or petition under the First Amendment, possession of arms under the Second Amendment, or searches, seizures, or surveillance under the Fourth Amendment. No criminal procedure, self-incrimination, or takings mandate implicates the Fifth, Sixth, Seventh, or Eighth Amendments. The order deregulates rather than restri…
  • ✓ Passes · Individual sovereignty
The order reduces prior restraint on private action by lowering regulatory and cost barriers to building, operating, extending, and restarting reactors and by capping hourly fees. It does not restrict what a person may do with their person, property, speech, labor, or belief, and it directs the regulator to weigh benefits to economic and national security alongside safety under the Fifth and Ninth…
  • ✓ Passes · Decentralization
Civilian nuclear licensing involves interstate commerce, radiological safety, and national security that individuals, counties, and single states cannot safely or uniformly handle, so federal administration is the minimum necessary level under the Tenth Amendment. The order does not transfer licensing from states or localities upward; it streamlines an already federal function and retains state ro…
  • ✓ Passes · Due process and takings
The order requires notice of proposed rulemaking and final rules within stated months, preserving Fifth Amendment procedural due process and the Administrative Procedure Act process of fair notice and comment rather than bypassing it. It creates no deprivation of life, liberty, or property, no presumption-of-guilt regime, and no physical or regulatory taking of private property without just compen…
