The President acts within Article II, Section 1 vesting of executive power and Article II, Section 3 duty to take care that the laws be faithfully executed. The Order implements existing statutes, principally the Federal Acquisition Streamlining Act of 1994, 41 U.S.C. 3307(d) and 10 U.S.C. 3453, enacted under Article I, Section 8, Clause 1 for common defence and general welfare and Clause 18 neces… -

The Order does not restrict speech, religion, assembly, press, petition (First Amendment), arms (Second Amendment), quartering (Third Amendment), searches or seizures (Fourth Amendment), self-incrimination or fair trial rights (Fifth and Sixth Amendments), jury rights (Seventh Amendment), or punishments (Eighth Amendment). (2) A local community or county cannot manage federal agency contracting. (3) A state cannot manage federal executive procurement without federal involvement. (4) The Order does not consolidate decision-making upward from states, localities, or individuals … -
✓ Passes · Due process and takings
The Order provides procedural regularity rather than bypassing it: written market research and price analysis under 41 U.S.C. 3307(d) and 10 U.S.C. 3453, written approval or denial by the approval authority, OMB consultation, and recurring compliance reports. It orders no deprivation of life, liberty, or property, no presumption of guilt, no warrantless seizure, and no physical or regulatory takin…
