Purpose. Overregulation chokes the American economy and stifles personal freedom. A small but meaningful example is the Obama-Biden war on showers: Twice in the last 12 years, those administrations promulgated multi-thousand-word regulations defining the word ``showerhead.'' See Energy Conservation Program: Definition of Showerhead, 86 Fed. Reg. 71797 (December 20, 2021); Energy Conservation Program for Consumer Products and Certain Commercial and Industrial Equipment: Test Procedures for Showerheads, Faucets, Water Closets, Urinals, and Commercial Prerinse Spray Valves, 78 Fed. Executive Order 14264 is constitutional. It uses lawful executive supervision to repeal a prior federal showerhead definition, imposes no new mandate, infringes no rights, takes no property, and returns choice to individuals and markets.

  • ✓ Passes · Enumerated powers
The President directs the Secretary of Energy to rescind a prior agency rule using authority under Article II, Section 1 and Article II, Section 3 to supervise execution of the laws, in connection with congressional energy conservation statutes. It claims no new legislative power under Article I, Section 8, imposes no new regulation, and by its terms is to be implemented consistent with applicable…
  • ✓ Passes · Bill of Rights
This order restricts no speech, religion, press, assembly, arms, privacy, or trial rights. It removes a prior regulatory definition rather than imposing a new mandate or search. No provision of the first eight Amendments is implicated, and no unenumerated right under the Ninth Amendment or reserved power under the Tenth Amendment is infringed. Fourth Amendment and First Amendment remain fully inta…
  • ✓ Passes · Individual sovereignty
The order expands individual choice over personal property and household use by removing a 13,000-word federal definition of showerhead. It imposes no new restriction on person, property, speech, labor, or belief. The burden test is satisfied because the government is reducing prior restraint rather than adding one, with no compelling justification needed to restore freedom.
  • ✓ Passes · Decentralization
This action moves decision-making downward. It rescinds a federal regulatory definition codified at 10 C.F.R. 430.2 and returns choice over showerhead design and purchase to individuals, local markets, and states. It does not consolidate power upward and is consistent with the Tenth Amendment reservation of non-delegated powers to the states and the people.
  • ✓ Passes · Due process and takings
No person is deprived of life, liberty, or property under the Fifth Amendment Due Process Clauses, and no property is taken for public use without just compensation under the Fifth Amendment Takings Clause. No criminal process under the Sixth Amendment is involved. The order creates no new penalty, seizure, or forfeiture, and Section 3 expressly creates no new enforceable right against the United …
