SI review finds Executive Order 14241 constitutionally sound: it directs faster federal permitting and use of federal lands under Property Clause and statutory authority, with no speech, arms, privacy, due process, takings, or sovereignty violation. Minor policy breadth in the Chair-defined mineral category does not create a constitutional violation.

  • ✓ Passes · Enumerated powers
The President acts under Article II, Sections 1 and 3 to direct executive agencies, supported by congressional statutes including 30 U.S.C. 1606, 10 U.S.C. 2667, 42 U.S.C. 7256, and the Fixing America's Surface Transportation Act. Management and leasing of federal lands rests on Article IV, Section 3, Clause 2, the Property Clause, and expediting domestic minerals for defense and infrastructure re…
  • ✓ Passes · Bill of Rights
No provision directs censorship, religious targeting, disarmament, quartering, warrantless search, compelled testimony, unfair trial, or cruel punishment. First Amendment speech, press, assembly and petition are unaffected; Second Amendment arms ownership is unaffected; Fourth Amendment search protections are unaffected because expedited permitting and federal-land leasing do not authorize searche…
  • ✓ Passes · Individual sovereignty
No person is barred from speaking, worshiping, owning property, working, or holding beliefs. The order does not compel labor, restrict land owned in fee simple, ban a product, or condition a personal liberty on government approval. It eases federal permitting bottlenecks and expands leasing and financing options for mineral projects, which widens rather than narrows private economic liberty. The g…
  • ✓ Passes · Decentralization
Large-scale mineral mining, processing, and permitting on federal lands cannot be handled by an individual or family, local county, or a state acting alone because title, land-use plans under the Federal Land Policy and Management Act, and permits are federal. The order does not transfer state or local mining authority to Washington; it directs faster exercise of existing federal authority over fe…
  • ✓ Passes · Due process and takings
The order does not order condemnation, seizure, fines, license revocation, or criminal punishment without notice and hearing. It directs agencies to identify priority projects, publish schedules, solicit industry feedback, recommend legislation on the Mining Act of 1872, and use authorized leases under 10 U.S.C. 2667 and 42 U.S.C. 7256 and public loan programs consistent with applicable law.
