What H.R. 6422 does, in plain terms

American Water Stewardship Act This bill reauthorizes several water quality protection and restoration programs of the Environmental Protection Agency (EPA) and makes related requirements. Specifically, the bill reauthorizes through FY2031 the Great Lakes Restoration Initiative, the Long Island Sound Partnership program, the Columbia River Basin Restoration Program, the National Estuary Program, and the BEACH Act program. The bill also modifies some of those programs. For example, the bill modifies the National Estuary Program, including by establishing the Mississippi Sound as an estuary of national significance that may receive support under the program. It also modifies the BEACH Act program, including by allowing states or local governments to use grants provided under the program to identify specific sources of contamination for coastal recreation waters adjacent to beaches or similar points of access that are used by the public. Additionally, the bill modifies the San Francisco Estuary Partnership, including by making federal agencies eligible for grants provided under the program. The bill also prohibits funding made available for FY2026-FY2031 to carry out specified Clean Water Act programs from being provided to nonfederal entities that are domiciled in, located in, organized under, have a principal place of business in, or have agreements with foreign countries of concern. Finally, the bill directs the Government Accountability Office to evaluate and report on specified geographic programs of the EPA.

The American Water Stewardship Act is mostly constitutional but has minor tensions. Federal authority over interstate water quality and spending is well-established under the Commerce and Spending Clauses. The bill does not directly infringe individual rights, though the funding restriction tied to foreign countries of concern raises mild Tenth Amendment and Spending Clause concerns. Decentralization is slightly compromised because these large-scale programs necessarily involve federal coordination, but the restriction on state and local choices consolidates power upward more than necessary.

  • ✓ Passes · Enumerated powers
The bill reauthorizes and modifies EPA water programs under the Clean Water Act, which is grounded in the Commerce Clause (Article I, Section 8, Clause 3) for regulating navigable waters and interstate commerce. The funding prohibition related to foreign countries of concern falls under the federal government's foreign affairs power (Article II, Section 2) and the Spending Clause (Article I, Secti…
  • ✓ Passes · Bill of Rights
The bill does not directly restrict speech, religion, assembly, press, petition, arms, quartering, search and seizure, self-incrimination, trial rights, or cruel punishment. The funding condition on foreign ties could indirectly affect associational rights (First Amendment) if applied arbitrarily, but as a condition on federal grants it is generally permissible under South Dakota v. Dole. No direc…
  • ✓ Passes · Individual sovereignty
The bill imposes conditions on federal grants to nonfederal entities, not on individuals directly. Entities may choose to accept or decline funds. The government has a compelling interest in environmental protection and national security. No restriction on personal property, labor, or belief without justification.
  • ✗ Concern · Decentralization
The bill fails one of the four questions. Individuals or families cannot handle large-scale water restoration (fails Q1). Local communities cannot manage interstate watersheds like the Great Lakes (fails Q2). States could partially handle but interstate coordination requires federal involvement (passes Q3). The funding restriction consolidates decision-making upward by imposing a federal foreign-p…
  • ✓ Passes · Due process and takings
The bill does not bypass procedural due process; it provides clear statutory conditions. No property is taken without just compensation because grant funds are discretionary, not vested rights. The GAO evaluation adds transparency. The funding restriction is defined (though 'foreign countries of concern' would need clear statutory definition to avoid vagueness challenges). No Fifth Amendment viola…
