What H.R. 3944 does, in plain terms

Military Construction and Veterans Affairs, Agriculture, and Legislative Branch Appropriations Act, 2026 This bill provides FY2026 appropriations to several federal departments and agencies for activities and programs related to military construction, veterans, agriculture, and the legislative branch. Specifically, the bill includes 3 of the 12 regular FY2026 appropriations bills: the Military Construction, Veterans Affairs, and Related Agencies Appropriations Act, 2026; the Agriculture, Rural Development, Food and Drug Administration, and Related Agencies Appropriations Act, 2026; and the Legislative Branch Appropriations Act, 2026. The departments, agencies, and activities funded in the bill include Department of Defense military construction and family housing activities, the Department of Veterans Affairs, the Department of Agriculture, the Food and Drug Administration, the Senate, various agencies that support Congress, and several related and independent agencies. (Pursuant to the longstanding practice of each chamber of Congress determining its own requirements, funds for the House of Representatives are not included in the Senate bill.) The bill also sets forth requirements and restrictions for using funds provided by this and other appropriations acts.

Routine FY2026 appropriations for core federal functions under Article I. Funds military construction, veterans affairs, agriculture, FDA, and the legislative branch pursuant to the Appropriations Clause, with no facial infringement of rights, sovereignty, federalism, or due process.

  • ✓ Passes · Enumerated powers
Congress has explicit authority to fund the federal government. Article I, Section 9, Clause 7 provides that no money shall be drawn from the Treasury but in consequence of appropriations made by law. Military construction is supported by Article I, Section 8, Clauses 12, 13, and 14, veterans programs by Clause 1 and Clause 18, and legislative branch funding by Article I, Section 1 and Section 6. …
  • ✓ Passes · Bill of Rights
The summary describes funding for military construction, veterans programs, agriculture, FDA, and legislative branch operations, with restrictions on use of funds. No provision on its face restricts speech, religion, press, assembly, or petition under the First Amendment, infringes the Second Amendment, authorizes searches under the Fourth Amendment, compels self-incrimination, or denies trial rig…
  • ✓ Passes · Individual sovereignty
The bill directs public funds to government departments and programs. It does not on its face prohibit private speech, belief, labor, property use, or bodily autonomy, nor compel private conduct. The burden to justify a restriction is not triggered because no individual liberty restriction is described. Any future agency use of funds that restricted liberty would require separate justification.
  • ✓ Passes · Decentralization
The core subjects are inherently federal functions that cannot be devolved: military construction and veterans affairs under Article I, Section 8, Clauses 12-14 and 18, and funding of Congress itself under Article I, Section 1 and Section 6. An individual, county, or state cannot provide national defense infrastructure or operate the federal legislature and VA system. The bill funds existing feder…
  • ✓ Passes · Due process and takings
An appropriations bill directing funds to departments and conditioning use of funds does not adjudicate guilt, impose punishment without trial, authorize seizure without warrant, or take private property for public use. No procedural due process violation under the Fifth Amendment Due Process Clause and no physical or regulatory taking requiring just compensation under the Fifth Amendment Takings …
