What H.R. 2550 does, in plain terms

Protect America's Workforce Act This bill nullifies the Executive Order titled Exclusions from Federal Labor-Management Relations Programs (issued on March 27, 2025), which excludes specified executive agencies and subdivisions from the Federal Service Labor-Management Relations Statute. The statute authorizes federal employees' participation in collective bargaining and enforces collective bargaining rights. The bill also specifies that a covered collective bargaining agreement in place as of March 26, 2025, shall have full force and effect through the stated term of the agreement.

HR 2550 is fully constitutional. Congress has clear authority under Article I to legislate on the terms and conditions of federal employment, including collective bargaining rights. The bill restores statutory protections that were removed by executive order, which is a proper exercise of legislative power. It does not infringe any constitutional right, respects individual sovereignty by preserving voluntary collective bargaining, operates at the appropriate federal level for federal employees, and does not violate due process or takings protections.

  • ✓ Passes · Enumerated powers
Congress has authority under Article I, Section 8, Clause 18 (Necessary and Proper Clause) to enact laws governing the federal workforce, including labor-management relations. The Federal Service Labor-Management Relations Statute is a valid exercise of that power, and HR 2550 simply restores that statute's application by nullifying an executive order that had carved out agencies. No enumerated po…
  • ✓ Passes · Bill of Rights
The bill does not restrict any right protected by the First through Tenth Amendments. It restores statutory collective bargaining rights, which are not constitutionally mandated but are permissible. No speech, assembly, or other rights are infringed; in fact, the bill may facilitate associational rights under the First Amendment by allowing federal employees to organize and bargain collectively.
  • ✓ Passes · Individual sovereignty
The bill does not restrict what individuals may do with their person, property, speech, labor, or belief. It preserves the ability of federal employees to voluntarily participate in collective bargaining through their chosen representatives. The government is not compelling any individual to join or refrain from joining a union; it is merely maintaining a statutory framework that allows collective…
  • ✓ Passes · Decentralization
The subject matter—federal employee labor relations—is inherently a federal function. An individual federal employee cannot unilaterally set terms of employment; collective bargaining requires group action. Local or state governments have no role in federal employment. The bill does not consolidate decision-making upward; it maintains the existing federal statutory scheme. All four questions are a…
  • ✓ Passes · Due process and takings
The bill does not deprive any person of life, liberty, or property without due process. It honors existing collective bargaining agreements by giving them full force and effect through their stated terms. No property is taken without just compensation; the bill merely restores the legal framework under which those agreements were made. Procedural and substantive due process are fully respected.
