The bill is a routine reporting requirement on an existing federal loan program, well within Congress's enumerated powers under the Spending Clause and the Necessary and Proper Clause. It imposes no restrictions on individual rights, does not centralize decision-making beyond the federal level already responsible for the program, and raises no due process or takings concerns.
-
✓ Passes · Enumerated powers
Congress has authority to enact laws regarding federal spending and to ensure the proper administration of federal programs. The 7(a) loan program is a federal program established under the Small Business Act, and this bill merely requires the SBA to report on the activities of loan agents who participate in that program. This falls within Congress's power to 'provide for the common Defence and ge… -
✓ Passes · Bill of Rights
The bill imposes no restriction on speech, religion, assembly, press, petition, arms, quartering, search and seizure, self-incrimination, due process, takings, trial rights, or cruel and unusual punishment. It merely requires the SBA to compile and submit statistical information about loan agents. No provision of the Bill of Rights is implicated. -
✓ Passes · Individual sovereignty
The bill does not restrict any individual's use of their person, property, speech, labor, or belief. It imposes no new obligations on individuals or private actors; it only directs a federal agency to produce a report. The reporting requirement is a reasonable exercise of congressional oversight over a federal program and does not burden individual liberty. -
✓ Passes · Decentralization
The 7(a) loan program is a federal program administered by the SBA. The bill does not consolidate any new decision-making authority at the federal level; it simply requires the federal agency already responsible for the program to report on its operations. The questions: (1) an individual or family could not handle the federal loan program without government involvement, (2) a local community coul… -
✓ Passes · Due process and takings
The bill does not deprive any person of life, liberty, or property without due process, nor does it take private property for public use without just compensation. It imposes no penalties, no adjudicative procedures, and no property seizures. It is a purely informational reporting requirement, so no due process or takings concerns arise.
