What H.R. 1501 does, in plain terms
Protecting Domestic Mining Act of 2025 This bill provides statutory authority for federal agencies to expedite the environmental review of certain mining infrastructure projects. Specifically, the bill permanently makes certain mining infrastructure projects eligible for expedited environmental review under the Fixing America's Surface Transportation Act (FAST Act). This provides statutory authority for similar authorities that were included in the rule titled Adding Mining as a Sector of Projects Eligible for Coverage Under Title 41 of the Fixing America's Surface Transportation Act and issued by the Federal Permitting Improvement Steering Council (Permitting Council) on January 8, 2021. The bill also prohibits the Permitting Council from finalizing its proposed rule titled Revising Scope of the Mining Sector of Projects That Are Eligible for Coverage Under Title 41 of the Fixing America’s Surface Transportation Act and issued on September 22, 2023. Among other modifications, the rule proposes to limit the types of mining projects that are eligible for the expedited environmental review process. Specifically, the proposed rule limits the expedited process to critical minerals mining projects.

SI-generated grade · five published checks · not individually reviewed by a person · methodology
Federal permitting-reform bill grounded in the Commerce Clause and Property Clause that speeds existing reviews without infringing rights, sovereignty, or due process, and without expanding federal power.
-
✓ Passes · Enumerated powers
Congress acts within explicit grants: Article I, Section 8, Clause 3 (Commerce Clause) for interstate mineral commerce and infrastructure, and Article IV, Section 3, Clause 2 (Property Clause) for management of federal lands where mining review occurs. Setting procedures for federal agency review is also supported by Article I, Section 8, Clause 18 (Necessary and Proper Clause). -
✓ Passes · Bill of Rights
No First through Tenth Amendment right is restricted. Expediting environmental review timelines does not abridge speech (First Amendment), arms (Second Amendment), or authorize searches (Fourth Amendment). No taking of private property is ordered, and no criminal procedure right is implicated. -
✓ Passes · Individual sovereignty
The bill restricts no personal conduct, speech, belief, labor, or private property use. It directs federal agencies to process permits faster and blocks a narrowing rule, which if anything reduces regulatory burden on private miners. No compelled action on individuals; government bears no unmet justificatory burden. -
✓ Passes · Decentralization
Four-question test: (1) Individuals cannot coordinate multi-agency federal permitting on federal lands. (2) Local counties cannot bind federal agencies. (3) States cannot control federal land permitting or interstate mineral commerce alone. (4) The bill does not consolidate new substantive power upward; it streamlines existing federal process and preserves broad mining eligibility rather than expa… -
✓ Passes · Due process and takings
No deprivation of life, liberty, or property without process under the Fifth Amendment Due Process Clause. Faster review does not eliminate notice, comment, or judicial review; it sets coordination deadlines. No physical or regulatory taking occurs and no just-compensation obligation under the Fifth Amendment Takings Clause is triggered.
